"Make the best use of what is in your power, and take the rest as it happens."

Over the past few weeks, we’ve noticed a recurring theme during our coffee catch-ups, strategy calls and onboarding calls with local property owners. The question comes in different forms, but the underlying anxiety is always the same:
“If I rent out my property, who is ultimately responsible for paying the utility bills—and what happens if the tenant refuses to pay?”
It is an understandable fear. With energy prices fluctuating, regulatory pressures mounting, and stories circulating about rogue tenants running up thousands of pounds in gas and electricity debt, many landlords feel vulnerable.

The truth? In property management—just like in life—we cannot directly control another human being’s choices. A tenant can technically stop paying rent, ignore their utility statements, or breach their contract.
What we can control, however, is how contracts are structured, how liabilities are assigned, and how risk is managed.
Here is the operational reality of utility bills, where legal liability lies, and how you can protect your cash flow from unexpected debt.
Under standard UK residential lettings (Single Let properties operating under Assured Periodic Tenancies or standard rental agreements):
The Tenant’s Direct Responsibility: If utility accounts (Gas, Electricity, Water, Council Tax) are registered directly in the tenant’s name, the legal contract is between the tenant and the utility provider.
The Landlord’s Shield: If a tenant vacates the property leaving behind unpaid energy bills that were in their name, energy suppliers have no legal right to demand payment from the landlord. The debt follows the individual, not the property address.
However, issues often arise when accounts aren't transferred promptly at check-in, or during void periods when meters revert back to the property owner.
This is where contract needs to clearly confirm who is liable for setting up new accounts with energy suppliers.
It's also a good practice to follow up with every new tenant -between one and two weeks after moving in - whether they successfully created their accounts with energy suppliers.
If you operate a HMO (House in Multiple Occupation) or a Serviced Accommodation property, the model changes.
In shared living spaces, tenants expect a "bills included" rent structure. Here, utility accounts remain in the landlord’s or management company's name.
This creates two distinct operational challenges:
Uncontrolled Consumption: Room-by-room tenants leaving heating on 24/7 with windows open.
Financial Risk: If a tenant stops paying their agreed rent portion, the landlord / management company still has to pay the central utility providers to keep the lights and heat on for the rest of the house.
So how do experienced property owners protect themselves when liabilities sit on their side of the fence?
Because you cannot control a tenant's personal habits, you must build systemic safeguards into your management approach:
Fair Usage Clauses & Smart Controls: In "bills included" tenancies, contracts should clearly define fair consumption caps. Pairing this with smart thermostat technology (like Landlord Thermostats set to reasonable temperature bands) prevents extreme wastage without compromising living standards.
Watertight Meter Administration: For single lets, taking photographic meter readings on the exact day of check-in and check-out—and formally submitting them to suppliers alongside tenant contact details—creates an undeniable audit trail that shields the owner.
Guaranteed Rent / Master Lease Models: This is where many of our landlord partners find ultimate peace of mind. Under our long-term fully managed and guaranteed rent solutions at MD Accommodation,we become the tenant. We take full responsibility for managing the property, selecting occupants, and covering operational overheads. Your guaranteed income arrives every single month, regardless of utility fluctuations or tenant behavior.
NOTE: If this is your preferred avenue, make sure the management company and the person behind the steering wheel can truly deliver on their promises. We've seen management companies with bad record for not covering their liabilities, leaving their landlords with big headache after abandoning properties with unpaid bills
It is easy to lie awake at night asking "what if?" questions. But anxiety usually comes from focusing on things outside our direct sphere of influence.
You can’t force every tenant to be conscientious, but you can choose a management strategy that transfers the risk away from your personal bank account. When your contracts are rock-solid, your administration is sharp, and your management team has skin in the game, utility scarcity becomes a non-issue.
Whether you have a single let property or an HMO in Coventry or Rugby, you shouldn't have to worry about unpaid bills or skyrocketing energy usage.
