From Silence to Resolution:
The Step-by-Step Reality of Managing
Rent Arrears
Last week, I wrote from the heart about a side of property management that rarely makes headlines: the physical, emotional, and financial strain placed on landlords when a tenant stops paying rent.
After publishing that piece, several landlords reached out to ask the obvious follow-up question: “When communication breaks down and rent stops arriving, what actually happens behind the scenes? How do you handle it?”

Today, I’m turning the page in our operational diary to share our exact process. Dealing with rent arrears isn't about emotional outbursts or panic. In fact it's about controlling the full scope of emotional roller coaster. It is about executing a clear, fair, and legally watertight framework—step by step.
Here is how we turn chaos into structure when a tenancy goes off track.
OH AND KEEP ON READING, TOWARDS THE END I HAVE A LITTLE SURPRISE FOR YOU!
Day 1: The Foundation (It All Starts Before the Keys Are Handed Over)
Every contract is a legally binding agreement. Both parties have rights, but both parties also have strict obligations.
In our business, we don't rely on generic templates downloaded off the internet. We partner with a leading UK legal firm to ensure our tenancy agreements are up to date, professionally drafted, and rock-solid. This document is our true north. When a issue arises, we don't argue—we refer back to the clear terms that everyone agreed to in writing.
To my surprise I still come across property managers and firms who operate on lodgers agreement, or even worse - no agreement. Wow, WE DON'T DO WILD WILD WEST!
First couple of weeks: The Human Touch & Verbal Summaries
When a rent payment misses its due date, we don't immediately jump to legal threats. Life happens, bank transfers delay, and people make mistakes.
Our first move is direct, personal communication:
The Phone Call: We reach out directly to understand what is happening.
The Written Summary: Immediately after the call, we send a text or email summarising the conversation, confirming what was discussed, and outlining the next steps.
The challenge? Some tenants simply refuse to pick up the phone. And when they see a missed call, they rarely call back.
When silence sets in, we send a formal, calm status summary. We remind them gently—but firmly—of the legally binding nature of their contract and the importance of addressing the issue before costs escalate. For many tenants, this reminder is enough to prompt a response. They want to avoid future legal consequences, so we work together to agree on a formal, manageable repayment schedule.
Once agreed, the repayment plan is logged directly into our management system, setting clear expectations for both sides.
After 14 days: Interest Charges & Complete Transparency
If arrears continue, contractually permitted interest charges are applied to the outstanding balance.
We explain this clearly to the tenant and update our system so they can see every penny calculated transparently. Because these terms were agreed to upfront in their contract, tenants understand that this is the standard cost of breaching their payment schedule.
Sometimes they try to argue, but we can easily point them towards an independent legal advice, who will confirm that if interest is included in the contract within permitted levels, it's fully legal and enforceable.
If a tenant sticks to their agreed repayment plan, we maintain positive, supportive communication to help them get back on track. Relationships are built on trust, and when a tenant shows good faith, we meet them halfway.
When Communication Fails
Unfortunately, not every tenant acts in good faith. Some go quiet again or repeatedly break their agreed repayment schedules.
At this point, the tone shifts from supportive to formal. We send regular rent arrears notices, clearly warning them of the legal steps ahead under post-2026 legislation:
The formal service of a Section 8 Notice.
The risk of court proceedings and the substantial legal fees associated with court orders.
What CCJ stands for and what impact it creates.
A strict deadline to settle the debt and avoid eviction.
For the vast majority of late payers, this is the turning point. Facing formal legal warnings and potential court records usually encourages even the most hesitant tenants to clear their debt.
The Final Stage: Legal Enforcement & Recovery
For the small minority who remain uncooperative, we take decisive legal action.
We serve a formal Section 8 Notice citing mandatory and discretionary grounds—specifically Ground 8 (serious rent arrears), Ground 10 (general arrears), and Ground 11 (persistent late payment). Serving these grounds under the updated framework creates immediate legal clarity and signals that the situation has reached its absolute end.
From there, our recovery process kicks in:
Regaining Possession: We secure the property lawfully either through an agreement or by court proceedings (very rare finalisation).
Deposit Deduction: We claim the full tenancy deposit to offset outstanding arrears and any property damage.
Debt Collection: Any remaining debt is handed over to our specialist partner debt recovery agency to pursue the balance legally.
Fresh Start: We carry out full safety checks, refresh the room, and onboard a vetted, reliable new tenant who appreciates a quality home.
So what's critical to make sure landlords are protected?
The fundamental part in nowadays challenges with property management relies on the right contract.
I would even take one step back and point out the accurate referencing process. And although we can do our best at this point, there could always be that one person who could slip through our process.
I remember my first eviction - I was stressed out, shaking all day long, thinking about it all the time, struggling to sleep at night... It sucked, but mentally I dealt with it and used it to sharpen our processes and reduce likelihood of unpaid rents.
What was the biggest issue - we were in it on our own. But you don't have to be. We're currently working with new, as well as experienced landlords to do the heavylifting with setting up tenancies right from the very beginning - what's done right upfront defends itself in the future.

Here's my promise to you!
As mentioned at the start of this BLOG, I want to share a little surprise with you.
The surprise is simply this - most situations involving rent arrears can be resoled in a peaceful manner.
Here's a text message from one of our tenants, who's leaving his room tomorrow. This tenant did not pay rent for 46 days; he gave us a notice a few weeks ago stating that he would move out by the end of October 2026.
As we started advertising his room, we scheduled first round of viewings and we notified him of it upfront. On the day of viewings our customer care expert went into the room and found the tenant sleeping, with all the mess on the floor and a dangling sock wrapped around a smoke alarm. Our expert could sense cigarettes in the room as well, right before our viewings! And guess what... He thought viewings would be taking place the following week.
We cannot accept this behaviour, therefore we used Section 8 notice to remove the tenant sooner under broken terms within our contract. And he's successfully moving out tomorrow. This morning he also messaged us, saying:
"Hi Magdalena, first off just wanna start by saying that I apologise for all the headaches like I know I haven't been tenant as of lately, however I'll be moving and should be all out by tomorrow morning and apologies for the late notice as well it's all kinds last minute. I know I owe two months of rent and was wondering can my deposit cover one month, while I fix up a payment plan for the other month as I really do wanna settle every penny owed and again sorry for any inconvenience caused by me it was never my intention."
Well, all I can say is that combined terms of great contract with our communication resulted in regaining the posession of the property with another tenant lined up to move in within the next 3 weeks.
IT'S ALL POSSIBLE, IT'S DEFINITELY SHOWING THAT IT CAN ALL BE RESOLVED AMICABLY! Well, at least with most tenants.
